Service Terms

AICC provides its General Discussion List service ("Service") to you subject to these service terms ("ST") which may be updated by AICC from time to time without notice. You can review the most current version of the ST at: http://www.aiccbox.org/about/Listserve_service_terms.asp.

AICC provides its members with the use of the AICC General Discussion List and the Service for the purpose of posting a message to all who subscribe to the list. This service is provided "As Is". AICC shall have no responsibility for any missed delivery, failure to store any user communications or settings, timeliness, deletions, malfunction or any other defect in the Service. Each user of the Service understands that all text, data and information of every nature whatsoever, including all messages and other materials (referred to as "Content") are the sole responsibility of the originator of the Content. Each user is entirely responsible for all Content that such user uploads, posts, emails, transmits, sends or otherwise causes to be transmitted or made available on or through use of the Service. AICC does not control the Content that is posted on or through the Service and AICC does not guarantee the accuracy, quality, integrity, lawfulness or appropriateness of such Content. Under no circumstances will AICC be liable in any way for any Content, including, but not limited to, any errors, omissions, mistakes in any Content or for any loss or damage of any kind incurred by virtue of the use of the Service or any Content which might be made available through or by the Service.

Each user of the Service and each person accessing, posting information, receiving information or otherwise making use of the Service agrees that such person will not use the Service to:

1. upload, post, transmit, email or cause to be placed on the Service or in the Content any information, message, writing, or other Content that is unlawful, abusive, inappropriate, defamatory, vulgar, obscene, libelous, hateful, that invades the privacy of another person, contains any information, allegation or statement which is racially, ethnically or otherwise objectionable or which disparages any person on the grounds of race, creed, religion, or national origin;
2. misrepresent the affiliation of the user with any entity or otherwise;
3. upload, post, email, make available or transmit any Content under such circumstances that constitutes a breach of a fiduciary relationship or contractual obligation, including, but not limited to, proprietary or confidential information;
4. upload, post, email, make available or transmit any Content which infringes the intellectual property rights of any party, including any patent, trademark, trade secret, copyright, or other rights;
5. upload, post, email, make available or transmit any unsolicited or unauthorized advertising or any form of solicitation;
6. upload, post, email, make available or transmit any material that contains software viruses or any computer program or programs intended to or which may interrupt, destroy, interfere with or alter the functionality of any software or hardware or telecommunications equipment;
7. violate any applicable law or regulation.

Each user of the Service acknowledges and agrees that AICC may disclose any Content posted by such user if required to do so by law or by any public authority or in the event AICC believes that such disclosure is reasonably necessary to comply with legal process or to enforce the ST.

Without limiting the generality of the above and foregoing terms each user agrees to comply with all applicable laws regarding the sending, transmission or making available of technical data exported from the United States or from any other country.

AICC reserves the right at any time and without notice to suspend or discontinue the Service or any part thereof, or to modify, change or alter the Service in any form. AICC may establish any procedures with respect to the Service and may delete any messages posted on the Service at such time as it deems appropriate. AICC shall have the right to terminate the use by any user of the Service at any time, with or without cause and with or without notice. AICC may provide, or permit other parties to provide links to other websites or resources. AICC shall not be responsible for the availability of such sites or resources. AICC is not responsible or liable for any advertising or other materials available or posted on any such other sites or resources.

Each user of the Service agrees to indemnify and hold AICC, its officers, agents, and directors and employees harmless from any and all claims or demands arising out of or relating to the Content submitted, posted, transmitted or made available by such member or any claim or demand arising out of the use by such member of the Service or the violation by such member of any of the provisions of the ST.
